Terms of use | Special Marine

These terms of use (the "Terms of use") govern access to and use of specialmarine.fr, published by SERANE GROUPE. They are distinct from the terms and conditions of sale, which govern orders. The French version prevails.

1. Purpose

The website is an online shop selling marine and plumbing supplies. It allows visitors to browse the catalogue, build a basket, place an order and follow their orders from a customer account.

2. Definitions

User: any person accessing the website, with or without an account.
Customer: a user who has placed an order, with or without an account.
Account: the personal area giving access to addresses, orders and preferences.
Product: an item offered for sale by Special Marine.

3. Acceptance and amendment

Using the website constitutes full acceptance of these Terms of use. Special Marine may amend them at any time; the applicable version is the one in force on the date of use. Users are informed of substantial changes by any useful means.

4. Customer account

Creating an account is free and optional: an order may be placed as a guest. Users undertake to provide accurate information and to keep it up to date. They are solely responsible for keeping their credentials confidential and for any activity carried out from their account, and must inform Special Marine without delay of any unauthorised use. E-mail verification may be required before certain operations.

5. User obligations

Users must not:

impersonate a third party or provide deliberately inaccurate information;
extract or reuse all or part of the catalogue, prices or descriptions by automated means;
harm the security, availability or integrity of the website;
circumvent the technical limitations in place, in particular anti-robot protection.

6. Availability of the service

Special Marine endeavours to keep the website available, without warranting uninterrupted access. The service may be suspended temporarily for maintenance, updates or security reasons, without compensation.

7. Intellectual property

The website, its design, trade marks, logos, databases and software are protected and remain the property of Special Marine or of its partners. Any unauthorised reproduction or exploitation is prohibited.

8. Personal data

The processing of personal data is described in the privacy policy and the use of trackers in the cookie policy.

9. Liability

Special Marine cannot be held liable for damage resulting from use of the website contrary to these Terms of use, from an interruption of the service, or from the content of third-party websites to which links may point.

10. Suspension and deletion of an account

Users may delete their account at any time from the "Privacy" section of their account; data required for invoicing is then kept for the statutory periods. Special Marine may suspend or delete an account in the event of a breach of these Terms of use, without prejudice to any remedies.

11. Applicable law

These Terms of use are governed by French law. The provisions on consumer mediation and jurisdiction appear in article 14 of the terms and conditions of sale.
