Returns and withdrawal

This page explains how to return a product bought on specialmarine.fr. It supplements articles 8 and 9 of the terms and conditions of sale. The French version prevails.

1. Right of withdrawal

If you are a consumer, you have fourteen (14) days from receipt of the last product of your order to withdraw, without giving reasons and without bearing any cost other than return shipping (articles L. 221-18 et seq. of the French Consumer Code).

To exercise it, inform us of your decision by an unambiguous statement, at contact@specialmarine.fr or by post. You may use the model withdrawal form, though you are not required to.

2. Returning the product

The product must be sent back to us no later than fourteen days after you notify your decision, in its original packaging where possible, complete and in resalable condition. You may handle the product as you would in a shop; you are liable only for any diminished value resulting from handling that goes beyond that.

Return shipping costs remain payable by you, unless the product is faulty, not as described or does not match your order: in that case we cover the return and send you a shipping label.

3. Refund

The refund covers the price of the product and the standard delivery costs originally paid. It is made no later than fourteen days after the product is recovered or proof of its dispatch is provided, using the same means of payment as the original transaction, unless otherwise agreed.

4. Statutory exceptions

The right of withdrawal does not apply, in particular, to goods made to your specifications or clearly personalised, to sealed goods which are not suitable for return for health protection or hygiene reasons once unsealed, or to goods which, after delivery and by their nature, are inseparably mixed with other items (article L. 221-28 of the French Consumer Code). This is stated on the relevant product page.

5. Faulty or non-conforming product

Report the problem to contact@specialmarine.fr, with photographs and your order number where possible. Once agreed, the return is arranged at our expense and the product is, at your choice, repaired, replaced or refunded, under the legal guarantee of conformity.

6. Legal guarantees

Regardless of the right of withdrawal, all our products benefit from the legal guarantee of conformity (articles L. 217-3 et seq. of the French Consumer Code, two years from delivery) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code, two years from discovery of the defect). 7. Business customers

The right of withdrawal is reserved to consumers. Business customers benefit from the applicable legal guarantees and may send us any commercial return request, which will be considered case by case.
